I'm thinking we start up a casual game of some sorts. I'm thinking something sci-fi based. 40k is the obvious choice, but I'm open to anything. Any thoughts, anyone?

You guys should probably know I GM IRL, and I've done enough games online to know how this stuff works. Trust me, I should be good for most things. Just need to know what people want to play, unless you want me to just choose something.

we're talking about warhammer 40k here where everything is overpowered but I can see where your coming from

Yeah, it's just capping people or making sure that everyone gets the chance to be equally OP. It's making sure everyone gets a fair chance. I can run a setting that isn't 40K if people want, but 40K is the easiest to go with.

Ok, consensus seems to be 40K.
Three restrictions in any 40K game I run:
No Tyranid characters (Hive mind does not count)
No named Special characters. I want to see your characters, not other people's.
Daemons are allowed, but are substantially weaker than in fluff - namely, because Daemons can suffer a permanent death. You're free to play a daemon, but understand that you won't be any more survivable than any other character.
Let's talk about what is allowed:
(Pretty much) any class from any faction of any race. Terminators? Sure. Guardsmen? Go for it. Exodite Eldar? Cool. Dreadnought? Ok. Necron Pariah? Excellent. Ork Squiggoth? Erm... difficult. You'll need a handler to communicate with other characters, but otherwise... you get the picture.
Bear in mind that, no matter what you play, everyone will have the same amount of GM favour, aka plot armour. Guardsman characters won't just die because they're guardsmen; Space Marines are not simply invulnerable. I'd rather keep an interesting Guard character in than a boring Space Marine, and I can assure you that how you're playing makes a much bigger impact than what you're playing.
If it comes to PvP (which it shouldn't, trust me) then I'll have final say on how things are resolved. No auto kills, auto hits, taking control of other's characters - we're all grown ups, so I don't have to go into this stuff with you. You all know how to behave.
So, with that out the way, throw characters at me guys.

Just use Horus Heresy rules, that way there is no way you can complain about being OVERpowered.
Honestly, pick a GM/DM/(InsertTitleHere) who knows how to manage a campaign. One problem you guys may be having is that you want to be something unreasonable, like a Deamon or Chaos Lord the like. I have not played a single campaign where any of the party members were more then relatively common people, at least within in their career. Sure they may have backstory fluff, like banished prince, wanted fugitive or uncovered a lost secret, but that shouldn't be an excuse to be automatically superior to the general populace. There is a reason there are level systems implanted, characters experience the world and eventually become powerful individuals, like a space marine captain or chaos lord. The DM should restrict it to easy to manage characters.
Terminators, chaplains, dreadnoughts, etc. should be prestige classes. Either you get so far into your levels that you prestige, or you do something in the campaign that would logically progress to one, like choosing an aspect warrior path or being severly wounded in battle to become a dread.
And try to work together to get your characters created. Perhaps see if there is a way you can have both of them involved in the backstory. And try to not have anything that would conflict with the lore. We can't be having Chaos be bros with Loyalists, Xenos working for an inquisitorial squad.
