If this doesn't get pushed out today it'll be a nice black eye for Microsoft. It's always nice to fail when there was a mass email to all Live members last night saying it was coming and the letter to the membership from the corporate veep of Xbox Live at Microsoft on the Live home page.

It's staggered timezone wise, eg West Coast USA can expect to get it roughly last as your not far from being the last place to change day

Well since the update forced itself on me my Xbox refuses to connect to Xbox live. When I troublshoot it says it can get the internet, but not Xbox live.
Holy Toledo took an hour for the new Terms of Service to come through to me apparently that's what my system was waiting on.
